What is a Mietspiegel?


A Mietspiegel provides an overview of rents of privately financed flats in a specific city or municipality that are customary in this locality. In accordance with the legal bases, the rents are indicated depending on the type, size, furnishings, condition and location of the flat, including the equipment related to energy consumption and condition. The Mietspiegel may only include rents that have been newly agreed or that have changed in the last six years.

In current rental agreements, the rent may only be increased up to the amount of the comparative rent that is customary in this locality. For new rental agreements in Munich, the rent may not be more than ten percent above the comparative rent that is customary in Munich.

The currently valid Mietspiegel for Munich 2025 [www.mietspiegel-muenchen.de] is what is known as a qualified Mietspiegel, which was compiled according to scientific principles and recognised as qualified by the Munich City Council. In accordance with Art. 558 of the German Civil Code, when requesting a rent increase for flats to which the qualified Mietspiegel is applicable, landlords must state the rent customary for the locality, which is determined on the basis of the Mietspiegel.

“What is the purpose of this survey?”
In this survey you will be asked a few simple questions that will help us determine whether your apartment is relevant for the re-creation of the Mietspiegel for Munich 2027. If this is the case, a Kantar representative will call you to arrange an appointment for a more detailed survey about your apartment. In this further survey, we will ask about the rent amount, type, size, and furnishings etc. of your apartment.

“Why was I contacted?” / “Do I have to answer the questions myself?”
Your household was randomly selected from the population register along with over 20,000 other households. You were included in the selection because you are of legal age and live in Munich.
The survey is not about you personally, but about the rental relationship and the apartment. We ask that the person in your household who is most familiar with the rental agreement fills out the questionnaire.

“Do I have to take part in the survey?” / “I don’t want to provide any information.”
You are obliged to provide complete and correct information to the best of your knowledge. This is mandated by the legislature. The obligation is regulated by Article 238 § 2 of the Introductory Act to the Civil Code (EGBGB).
Even if you are the owner or are convinced that your apartment is not relevant for the Mietspiegel, you must take part in this survey. When evaluating the data, it is important that we also record which apartments are not relevant for the Mietspiegel.

“How is my personal information protected?”
The City of Munich is responsible for complying with the legal provisions on data privacy. Kantar is legally obligated to strictly observe all provisions related to data privacy as part of a data privacy agreement, this applies to the General Data Protection Regulation (GDPR) in particular.
